General provisions<\/h2>\n

These Terms and Conditions govern the rules for using the website https:\/\/happycleverkids.com\/shop\/ and the other sections of the domain happycleverkids.com, including the online store, user account registration, submission of enquiries, newsletter subscription and the ordering\/purchase of products and services offered by HAPPY CLEVER KIDS OOD, UIC 206931281, with registered office and address of management in Ruse (7000), 14 Burov Str., represented by Nikola Kibritev, hereinafter referred to as the \u201cTrader\u201d or the \u201cController\u201d.<\/p>\n

By using the website, creating an account, sending an enquiry, subscribing to the newsletter or placing an order, the user declares that they are familiar with these Terms and Conditions and undertakes to comply with them. Where the law or the functionality of the website requires an explicit action, consent shall be deemed given after an active checkbox selection or another clear confirmation by the user.<\/p>\n

Subject of the website<\/h2>\n

  • presentation of the activity of Happy Clever Kids as a children\u2019s\/family event centre;<\/li>\n
  • offering goods through an online store;<\/li>\n
  • providing information about events, workshops and other activities;<\/li>\n
  • possibility to create user accounts;<\/li>\n
  • possibility to send enquiries through contact forms;<\/li>\n
  • possibility to subscribe to a newsletter and marketing messages where the user has given separate consent.<\/li>\n<\/ul>\n

    Conclusion of a distance contract<\/h2>\n

    The publication of products and services on the website constitutes an invitation to submit an offer for the conclusion of a contract. The contract shall be considered concluded after an order has been placed by the customer and accepted\/confirmed by the Trader by email, telephone or another durable medium. The Trader has the right to request clarification, to refuse an order in the event of an obvious error, lack of availability, suspicion of abuse or impossibility of fulfilment.<\/p>\n

    Where events or places for participation are also offered through the website, the contract shall be considered concluded after confirmation of the registration by the Trader and subject to availability. For children\u2019s events, the application must be made by an adult \u2014 a parent, guardian, custodian or another authorised person.<\/p>\n

    Prices, payment and delivery<\/h2>\n

    All prices are indicated in euro and their equivalent in Bulgarian leva in brackets. The Trader may offer different payment and delivery methods depending on the current technical settings of the website, including cash on delivery, bank transfer, card payment through an external payment provider or another clearly indicated method. The specific delivery conditions, timeframes and costs are indicated during the ordering process.<\/p>\n

    Delivery is carried out through external courier operators or in another agreed manner. The risk of accidental loss or damage passes to the consumer in accordance with the applicable consumer legislation. In case of delay caused by a courier, force majeure, public holidays or unforeseen circumstances, the Trader shall notify the consumer within a reasonable period.<\/p>\n

    Right of withdrawal and complaints<\/h2>\n

    The consumer has the right to withdraw from the distance contract within 14 days from receipt of the goods, except in cases where the law excludes this right. The goods must be returned in preserved commercial condition, without signs of use beyond what is necessary to establish their nature, characteristics and proper functioning. Return costs shall be borne by the consumer, unless the law provides otherwise or the Trader has expressly undertaken to cover these costs.<\/p>\n

    Complaints regarding non-conformity of goods shall be submitted in accordance with the applicable Bulgarian legislation. Signals and complaints may be submitted by email to info@happycleverkids.com or by telephone at 0883432200.<\/p>\n

    User accounts and user-generated content<\/h2>\n

    Where the website allows registration, the user is obliged to provide accurate and up-to-date information, to keep their password confidential and not to allow unauthorised access to the account. The Trader has the right to restrict or terminate an account in case of violation of the law, these Terms and Conditions, abuse, attempted unauthorised access, publication of illegal content or damage to the interests of other persons.<\/p>\n

    Where the website provides the possibility to publish comments, reviews or other content, the user bears full responsibility for its legality. Offensive, discriminatory, obscene, misleading or rights-infringing materials are prohibited.<\/p>\n

    Intellectual property<\/h2>\n

    All texts, images, logos, design, descriptions, photographs, graphic elements, databases and other materials on the website are protected by the applicable intellectual property law. They may not be used beyond what is permitted by law without the prior written consent of the Trader or the relevant rights holder.<\/p>\n

    The Trader makes reasonable efforts to maintain accurate and up-to-date information, but does not guarantee that the content is complete and free from technical inaccuracies. To the extent permitted by law, the Trader shall not be liable for damages resulting from temporary unavailability of the website, actions of third parties, failures in the internet network, external integrations, courier delays or unlawful conduct by users.<\/p>\n

    Applicable law and disputes<\/h2>\n

    All matters not settled herein shall be governed by the applicable Bulgarian legislation and the law of the European Union. Disputes shall be resolved through negotiations, and if no agreement is reached \u2014 by the competent Bulgarian court.
